Welcome to the website of MGM Development Corp (“we,” “our,” or “us”). By accessing or using our website, requesting a quote, or purchasing any of our products or services, you agree to these Terms & Conditions. Please read them carefully before proceeding.

1. General Information

MGM Development Corp provides kitchen, bath, and home improvement materials and services, including granite, quartz, natural stone, cabinetry, and installation. All sales and projects are governed by these Terms & Conditions.

2. Quotes & Pricing

  • All quotes are valid for 30 days unless otherwise stated.

  • Prices are based on the materials, measurements, and details provided at the time of the estimate. Changes in material selection, edge profiles, sink cutouts, or installation details may result in updated pricing.

  • Sales tax, delivery, and installation charges may apply where required by law.

  • MGM Development Corp reserves the right to correct pricing errors or omissions at any time before final invoicing.

3. Payments

  • A deposit may be required to begin fabrication or order materials.

  • The balance is due upon project completion or delivery, unless otherwise stated in writing.

  • We accept major credit cards, checks, and electronic payments. Returned checks may incur an administrative fee.

  • Title to goods remains with MGM Development Corp until payment is made in full.

4. Cancellations & Changes

  • Orders that have entered fabrication or material cutting cannot be canceled or refunded.

  • Design or measurement changes made after approval may result in additional charges and scheduling delays.

  • If a cancellation occurs before fabrication, MGM Development Corp may retain a portion of the deposit to cover administrative and material costs.

5. Materials, Storage & Color Variations

Natural and engineered stones, slabs, tile, cabinetry, and other materials may vary in color, pattern, veining, shade, and texture. These variations are inherent characteristics of the materials and are not considered defects.

  • Samples, renderings, and digital images are provided for general reference only.

  • MGM Development Corp is not responsible for differences between sample colors, digital representations, printed images, and actual installed materials.

  • Slight variations between batches, slabs, and production runs are normal and expected.

Material Holds & Storage Policy

  • Material hold prior to purchase:
    Materials may be placed on hold for up to 72 hours (3 days) prior to purchase.
    After 72 hours, any unpaid material hold will be automatically released.

  • Purchased materials – initial responsibility period:
    Once materials are purchased, MGM Development Corp is responsible for coordinating shipment to the designated fabricator (ours or the client’s) for a period of up to 7 days.
    After 7 days, all materials are considered held at the client’s request.

  • Extended holding period (no charge):
    Following the initial 7-day period, MGM Development Corp may hold purchased materials for up to 90 days at no charge.
    During this time, MGM Development Corp assumes no responsibility for damage, discoloration, warping, breakage, theft, or any other issues that may occur while materials are on hold.

  • Storage beyond 90 days:
    Materials held beyond 90 days are subject to a storage fee starting at $150 per month, based on material type, quantity, and project size.
    Unpaid or unclaimed materials may be released, resold, or discarded at MGM Development Corp’s discretion.

  • No cancellations / refunds:
    After 7 days from purchase, materials are non-cancellable and non-refundable, regardless of project delays or changes.

6. Installation & Site Conditions

  • Customer must ensure that cabinets, walls, and supports are level, secure, and ready before installation.

  • Plumbing and electrical work are the responsibility of the customer unless explicitly included in the agreement.

  • MGM Development Corp is not liable for delays caused by inaccessible job sites, missing materials, or work performed by other contractors.

7. Warranties

  • Material warranties are provided by the manufacturer (e.g., stone or cabinet supplier) and vary by brand.

  • This warranty does not cover damage caused by misuse, neglect, exposure to harsh chemicals, heat, or structural shifting.

8. Photography & Marketing

By engaging our services, you grant MGM Development Corp the right to photograph completed projects for marketing and portfolio purposes. If you wish to opt out, please notify us in writing prior to installation completion.

9. Return Policy

All returns are subject to approval and must be initiated by email or phone.

  • Returns must be requested within 48 hours of delivery or pickup.

  • Returned items must be in original, unused condition and packaging.

  • Approved returns are subject to a 30% restocking fee.

  • All shipping, handling, and transportation costs related to returns are the customer’s responsibility.

  • Custom materials, special orders, fabricated items, cabinetry, fully assembled products, or items that have been cut, built, installed, or modified cannot be returned under any circumstances.

10. Limitation of Liability

To the fullest extent permitted by law, MGM Development Corp shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our products or services. Our total liability is limited to the amount paid for the specific product or service in question.

11. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida. Any disputes arising under these terms shall be resolved in the courts of Palm Beach County, Florida.
